<p>-          The legal placement fee to be collected by licensed recruitment agencies from applicants for overseas jobs must be equivalent to one month salary of the worker as stipulated in the employment contract. The amount, however, does not include documentation and processing costs.</p>
<p>-          Documentation costs include fees for passport, NBI/Police clearance, medical examinations, medicare premium, trade tests, authentication, birth certificate. Processing costs include visa, POEA processing fee, and OWWA membership fee to be paid by the employer.</p>
<p>•        Our company wants to hire Filipino workers for our overseas projects. What are the requirements before we can recruit the workers?</p>
<p>-          Only entities licensed by the Department of Labor and Employment through the Philippine Overseas Employ­ment Administration may recruit Filipino workers for employment overseas. A foreign company may therefore hire Filipino workers by engaging the services of a licensed recruitment agency in the Philippines.</p>
<p>•        My husband is an OFW My children and I want to go to the place where he is work­ing. Do we have to pay for the travel tax?</p>
<p>-          The family of an <a title="Overseas Filipino Workers" href="http://www.globalofw.com/category/overseas-filipino-workers" target="_blank">overseas Filipino worker</a> may avail of a reduced travel tax when they go abroad while the <a title="OFW" href="http://www.globalofw.com" target="_blank">OFW</a> has an existing employment contract. The reduced travel tax certificate is issued by the Department of Tourism. <p>•        My son wants to withdraw his application from an agency because it has failed to deploy him after so many months now. Can we claim for reimbursement of my expenses?</p>
<p>-          Yes, you can claim for reimbursement of placement fee, documentation and processing expenses from the agency if deployment did not happen without your fault. You may file an administrative case against the recruitment agency through POEA&#8217;s Legal Assistance Division.</p>
<p>•        My wife&#8217;s contract was for 2 years but my employer dismissed her after 3 months of work. Can we sue for breach of contract and claim for unpaid wages.  Where shall I file the case?</p>
<p>-          You may sue your employer and its agent if you were dismissed without valid reasons. Money arising from employer-employee relationship such as unpaid wages, breach of contract or illegal dismissal may be filed with the Migrant Worker&#8217;s Desk of the National Labor Relations Commission in Quezon City or in NLRC&#8217;s Regional Arbitration Branch in the region you reside.</p>
<p>•        My husband is spending his vacation in the Philippines and will go back employer  after one month. Does he have to go through POEA processing again?</p>
<p>-          No, he need not go through the whole process again. The employer and employment contra already verified. As a returning overseas Filipino worker or &#8220;balik-manggagawa&#8221; all that needs to I Is secure an overseas employment certificate (OEC) at the POEA Balik-Manggagawa Processing I regional centers and satellite offices and some Philippine Overseas Labor Offices to enable OFWs to the country again and avail of the same privileges such as exemption from travel tax and airport fee.</p>
<p>•        I was hired as a consultant in facilitating the documentation of immigrant being recruited for employment in US hospitals. Do we have to secure a license for the with immigrant workers?</p>
<p>-          Yes, you need to secure a license from POEA if your immigration consultancy and other similar en- not limit your assistance to processing and facilitation in the issuance of immigrant visa but will engage in the recruitment and placement of workers, whether on worker&#8217;s visa or employment-based immigration visa, without a license or authority issued by POEA, you shall be subjected to prosecution for illegal recruitment  and such other appropriate action as may be necessary pursuant to the pertinent provision RA 8042 and its implementing rules and regulation (MC #10).</p>

<p><strong>HALALAN 2010 TALLY OF VOTES HAS BEGAN</strong></p>
<p>COMELEC or the Commission On Elections  said it will release around 7 p.m. <strong>Manila, Philippines </strong>time the URL (uniform resource locator) of  its website, which will contain partial tally or electronic counts that will be  sent by PCOS or Precinct Count Optical Scan machines.</p>
<p>Larrazabal, one of the Comelec Commissioners said that the first &#8220;official results, but unofficial tallies&#8221;  will consist of 20% of the total votes cast from 7 a.m. to 7 p.m..</p>
<p>The succeeding results that will be fed into the URL (uniform resource locator) of  its website will come in  10% batches &#8220;so everybody will be updated.&#8221;</p>
<p>Larrazabal said the national board of canvassers will suspend  proceedings by 7 p.m. and reconvene at 10 a.m. Tuesday May 12, 2010.</p>
<p>He assured that updates on the transmission of electronic votes will  be non-stop from 7 p.m. Monday until all votes are counted. He added that the votes that will be seen on the website are  electronically sent by each PCOS machines, which is why the Comelec  calls them &#8220;unofficial tallies.&#8221;</p>

The amended Migrant Workers and Overseas Filipinos Act  <strong>now exempts Ofws or Overseas Filipino Workers</strong> <strong>from paying documentary  stamp tax (DST) on their remittances, travel tax and airport fee.</strong></span></p>
<p style="margin: 0pt; font-family: Verdana;"><span style="font-size: medium;"><br />
The law exempts Overseas  Filipino Workers and migrant workers from the payment of travel tax, documentary stamp tax or DST and airport fee upon  showing of proof of entitlement from the POEA or Philippine  Overseas Employment Administration</span>.</p>
<p style="margin: 0pt; font-family: Verdana;">
<p style="margin: 0pt; font-family: Verdana;"><span style="font-size: medium;"> According to Section 22 of Republic Act 10022 “<em>The remittances of all OFWs, upon showing the same proof of  entitlement by the OFW beneficiary or recipient, shall be exempted from  the payment of documentary stamp tax.</em>’’ </span></p>
<p style="margin: 0pt; font-family: Verdana;"><span style="font-size: medium;"><br />
According  to former labor undersecretary and now Nacionalista Party (NP)  senatorial bet Susan Ople the scrapping of the DST is very timely  because it could help the OFW beneficiaries here recover some of the  buying power they lost due to the peso’s surge against the dollar.   “Overseas Filipino Workers can now count on some P1.3 billion in extra  savings with the abolition of the DST on all their remittances,’’ Ople  said, as she cited Department of Finance’s projection at $19 billion  worth of remittances this year.  The removal of the documentary  stamp tax or DST on all funds wired home by OFWs would help  drive down money transfer charges, and put more cash in the pockets of  those receiving remittance,’’</span></p>
<p style="margin: 0pt; font-family: Verdana;"><span style="font-size: medium;"><br />
Before to the passage of the amended Migrant Workers and Overseas Filipinos Act or RA 10022, all <span style="text-decoration: underline;">money transfers and remittances</span> from abroad and payable  in the Philippines, including those wired home by Overseas Filipino  Workers were subject to the documentary stamp tax (DST) at a rate of P0.30 for every P200.</span></p>
<p style="margin: 0pt; font-family: Verdana;"><span style="font-size: medium;"><br />
An  estimated 10 million Filipinos, migrants and contract workers are  working abroad. OFWs remit around $17 billion annually and have been the  Philippines economic saviors for over three decades already.</span></p>
<p style="margin: 0pt; font-family: Verdana;"><span style="font-size: medium;"><br />
Susan  Ople stated that local banks and non-bank money transfer agents such as  Moneygram International, Inc. and The Western Union Co. collect the documentary stamp tax (DST) before the funds sent home  by Overseas Filipino Workers are actually paid out to their  beneficiaries or families here. This means that OFWs pay a documentary stamp tax (DST) of P33.27 for every $500 or  P22,180 (at $1:P44.36) they send home. The amount is on top of foreign  and local bank fees, plus the P0.50 to a dollar margin domestic banks  that are allowed when paying out remittances in pesos.</span></p>
<p style="margin: 0pt; font-family: Verdana;"><span style="font-size: medium;"><br />
Migrante  International believes the Philippine government has had enough from  the billions of dollars of <strong>OFW remittances</strong> it received yearly and it is  therefore high time for the government to do the saving.</span></p>

<p>-       First things first, <strong>DO NOT PANIC</strong>. It is important to remember the earthquake safety tips and use them to the best of your ability. If you panic, you will not be able to help yourself and your loved ones.</p>
<p>-      According to Doug Copp. A Rescue Chief and Disaster Manager of the American Rescue Team International (ARTI), the world&#8217;s most experienced rescue team and a United Nations expert in Disaster Mitigation: &#8221; <strong>What people should do is to have a greater chance of survival is</strong><strong> </strong><strong>to lie down next to their desks in the aisles. </strong>&#8221;</p>
<p>Simply stated, when buildings collapse, the weight of the ceilings falling upon the objects or furniture inside crushes these objects, leaving a space or void next to them. This space is called the &#8220;<strong> triangle of life </strong>&#8220;. The larger the object, the stronger, the less it will compact. The less the object compacts, the larger the void, the greater the probability that the person who is using this void for safety will not be injured.</p>
<p>Cats, dogs and babies often naturally curl up in the fetal position. You should too in an earthquake. It is a natural safety/survival instinct.  You can survive in a smaller void.</p>
<p>-      Never go to the stairs. The stairs are a likely part of the building to be damaged. Even if the stairs are not collapsed by the earthquake, they may collapse later when overloaded by fleeing people.</p>
<p>-      When you are in your car, get out of your car and sit or lie next to it. You can easily survive by doing this simple thing.</p>

The Red Cross is not saying that identifying potential voids is wrong or inappropriate. What we are saying is that &#8220;Drop, Cover, and Hold On!&#8221; is NOT wrong &#8212; in the United States. The American Red Cross, being a U.S.-based organization, does not extend its recommendations to apply in other countries. What works in the US may not work elsewhere, so there is no dispute that the &#8220;void identification method&#8221; or the &#8220;<strong>Triangle of Life</strong>&#8221; may indeed be the best thing to teach in other countries where the risk of building collapse, even in moderate earthquakes, is great.</p>

<p>-       Check yourself for injuries and if there are any apply first aid. Check others for injuries and give first aid for serious injuries.</p>
<p>-       If the phone is working, use it only in case of emergency. You can use your cellphone and call your loved ones.  Avoid driving if possible to keep the streets clear for emergency vehicles.</p>
<p>-       Expect aftershocks. Sometimes large enough to cause damage in their own right, generally follow large earthquakes. Listen to the radio for important information and instructions.</p>
<p>It is important to educate yourself and your loved ones about the earthquake safety and survival tips. Who knows when an earthquake would strike but if you know these earthquake <span style="text-decoration: underline;">safety and survival tips</span>, you would have a greater chance of surviving and you can also help save other people’s lives.</p>
